Possessing marijuana is a misdemeanor. If you bring it from a state like Ohio, which just legalized it, you could face fines and charges.

“Our troopers are trained in the detection of illegal narcotics to include marijuana,” says State Police Sergeant John Perrine. “If they (police) come across it, it’s still against the law. They have to proceed with Indiana law.”

Indiana hasn’t legalized marijuana, but Ohio, Michigan, and Illinois allow recreational use, while Kentucky allows it for medical use with a card.

The issue of legalizing weed in Indiana has sparked a lot of debate. Indiana Democrat for Governor nominee Jennifer McCormick supports legalization, arguing that the revenue from sales could help address the state’s property tax problem. She has also said that there are some medical benefits to marijuana.

For Indiana law enforcement, the message is clear: it is illegal to buy marijuana in any state and bring it back to Indiana.

“If you’re found to be impaired, under the influence of marijuana and you’re driving a vehicle it can be the same of operating with alcohol in your system,” Perrine says.

In Marion County, prosecutors usually don’t charge people for possessing less than an ounce of marijuana. However, if you have more than an ounce in Indianapolis, you could still face criminal charges.
