A Nappanee teen initially charged with causing death when operating a vehicle while intoxicated will not be charged with that charge.

The crash happened in Nappanee on October 15 when reports say a vehicle, driven by Solano Cruz, crossed the center line and drove into the pathway of a transit van heading south.

Cruz reportedly told police that he had never received a license, and police said his eyes were bloodshot and glassy and his speech was slow and slurred. One of the ten passengers in the van died at the scene, and others were reported injured.

The court learned that 18-year-old Cruz was actually not intoxicated, and they dropped the charges. However, The Goshen News says Cruz pleaded guilty to Identity Deception and was sentenced to one year on probation.
